Security bond for the administrator of a mentally incapacitated person

In South Africa, a person can be appointed an Administrator of another person in terms of section 59 of the Mental Health Care Act (2002).

An application needs to be made to the Master of the High Court and there are a number of requirements laid out within the Act.  One specific requirement, is the need for a security bond.

A security bond is a guarantee that the appointed Administrator will perform their duties in terms of the Act and protect the interests of the incapacitated person.

The bond is designed to ensure that the administrator will act in the best interests of the incapacitated person and will not engage in any activities that could harm the person or their estate. If there is any malfeasance on the part of the Administrator the bond can be used to cover any losses. The specific requirements for a security bond for an Administrator of a mentally incapacitated person will vary depending the appointed Administrator. Rodel Risk Solutions provide these very specific security bonds and assist a number of Administrators throughout South Africa.
